US23 - Reschedule Marijuana Through Presidential Directive
Description
Schedule 1 drugs in the Controlled Substances Act are reserved for drugs which have "no currently accepted medical use." Marijuana has known medical uses.  Therefore, marijuana should not be classified as a Schedule 1 controlled substance.

I propose that the Obama Administration issue a Presidential Directive to the Drug Enforcement Agency to remove marijuana from the Schedule 1 list of drugs covered in the Controlled Substances Act.
Arguments

Two reasons why marijuana should not be listed as a Schedule 1 substance:
Heroin is Schedule 1.
Meth is Schedule 2.

Marijuana is plainly not in the ballpark of Schedule 1, and drugs in Schedule 2 are by far more dangerous than marijuana.  

Schedule 3 and 4 are for prescription drugs, and alcohol and tobacco are not scheduled drugs.  Either of these options would suffice.

Four states -- Colorado, Washington, Vermont and Rhode Island -- have already petitioned  the Drug Enforcement Administration to reschedule cannabis out of Schedule I.

OK, this isn't a counterargument, it's a side argument that Chong (yes, of Cheech and Chong) proposed on Don Lemon's CNN show last (Sat. 9 May) night. He wants to just decriminalize it, but not regulate it, because if the gov't regulates it, it will be subject to taxation and will be priced out of the market for the poor to be able to use it. (Like what happened to cigarettes, although it's still mainly the poor who smoke them and they're harmful.) I know that taxation is an argument we want to use to convince people to decriminalize it, though....

Legalization would decrease the price of marijuana

Taxing marijuana if it were legal would not necessarily increase the price of marijuana. You pay a premium for an illegal drug when you buy it off of the street. It's not the drugs themselves that costs so much; it is the process of getting it illegally into your hands and the risks that all those people took and the underground demand for it. Taxation would also be controlled because if it is too high it would defeat the purpose of legalization. People would just buy it off of the street. Legalization and taxation would actually decrease the price of marijuana.
