USNY3 - Expert Juries
Description
The subject matter of a technical (ie, patent infringement) or financial (ie, insider trading) lawsuit or criminal proceeding is far too complicated for the average layperson to grasp.  As a result, juries are easily confused and manipulated and it is difficult to know whether their verdict reflects a true grasp of the dispute or charges.  Citizens with a particular expertise in the subject matter should be utilized in such cases.  A jury is to be comprised of one's "peers", so it is only fair that individuals involved in lawsuits/criminal activity involving technical or complicated financial material be judged by those with similar experience or expertise.

  • This is fitted best with private firms and I'm not sure where you're coming from with this. The Law is a complicated subject and trying to simplify it is not going to work, per se because it's already simplified as it is. It's just a matter of people comprehension skills and critical thinking being up to speed.
