Idea #US13 - Stop the Gerrymandering!

States should have neutral organizations do their congressional redistricting, rather than state legislatures.

 

Argument
When state legislatures make redistricting decisions, the party in power works hard to optimize their party's chances, often creating bizarrely shaped districts just to get the right voters into a district.  Very few congressional districts are actually competitive, given the way votes are gerrymandered, which is bad for democracy.

Idea #US2 - Abolish Death Penalty

Congress should abolish the death penalty.

 

Argument
Congress should seriously study the costs, deterrent effect and biases inherent in imposition of the death penalty.  After such a study, it will become clear that the death penalty is senseless and unjust.

Argument
Candidates should have to release more than just a few tax returns.  In the 2012 election, Mitt Romney's refusal to release more than two years of tax returns raises serious concerns about what might be hidden in other returns. As Mitt's own father, George Romney, said when explaining why he was releasing twelve years of tax returns, "One year could be a fluke, perhaps done for show, and what mattered in personal finance was how a man conducted himself over the long haul."

Argument
The disruptions caused by Hurricane Sandy will continue after the election -- Con Ed says only that it expects to restore power to the vast majority of customers by November 10 or 11 (coned.com), not to mention people whose homes have been destroyed. For these people to be accommodated, it seems like we have to be open to the possibility of extending the election beyond November 6.

Argument
This made me chuckle, but it really is a good idea -- there should be a visible indicator of how much politicians are beholden to particular groups.  The biggest problem -- some may not have room for all of the buttons!

Congress should abolish the death penalty.

 

Argument

I don't believe the death penalty is a deterrent, despite studies that might suggest otherwise.  Most people who commit murders either do not expect to be caught or do not carefully weigh the differences between a possible execution and life in prison before they act. Frequently, murders are committed in moments of passion or anger, or by criminals who are substance abusers and acted impulsively.  Also, states without the death penalty consistently have lower murder rates than states with the death penalty. 

 

I'm sure a review of the few studies saying that the death penalty is a deterrent would reveal significant flaws and inconsistencies in those studies.

Argument
Eating habits are formed at an early age.  Exposing children primarily to unhealthy options at school is bad for children, and has long-ranging consequences.

Texas should stop using the Texas Assessment of Knowledge and Skills ("TAKS") test.

 

Argument

Apparently, Texas has a five-year contract with Pearson Educational Measurement -- the publisher of TAKS -- for $100 million each year.  At the same time, Texas is cutting the education budget and dismissing teachers. TAKS is a terrible use of resources for education.

 

I wonder if pressure from Pearson keeps TAKS going, despite it's unpopularity.

Capital punishment only for people who commit murder in prison.

 

Argument

I oppose capital punishment in all circumstances, but if there has to be some method for removing from society people who truly can't be reformed, it would be to execute only those who commit murder in prison. 

 

Unlike in most instances, imposing the death penalty on people who commit murder in the tightly controlled environment of prison might actually have a deterrent effect, because people who commit such murders should know they are likely to be caught and are probably not intoxicated.  Such a policy would also mean that the only people who are executed are the ones who have shown that life imprisonment is not enough to protect society from them.  And I assume that there would be near certainty of guilt, because of close monitoring by prison guards.

Argument

Standardized testing like the TAKS test encourages teachers to "teach to the test" -- because schools get in trouble when scores are below minimum expectations, most have created a test based local curriculum. Students are made just to memorize answers that they expect to see on the test and don't actually learn.

Article IV, Paragraph 3 of the Constitution says, "The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious test shall ever be required as a qualification to any office or public trust under the United States."  Are you looking to change this dictate of the most-revered founding fathers?

Legalize gay marriage by federal statute. Denying gay marriage is clearly unconstitutional on equal protection grounds.

 

Counterargument

I'm all for the federal government legalizing gay marriage, but would such a law be constitutional? In finding certain provisions of the Defense of Marriage Act unconstitutional, a federal court found that states have the authority to regulate and define marriage, because marital status determinations traditionally have been viewed as falling within a state’s sovereign power. I'm not sure if this is the way it has to be, or just the way it traditionally has been, but a federal law legalizing gay marriage might be unconstitutional.

Trial by jury should not be a right, it should be mandatory.

 

Counterargument
Jurors often don't understand complicated issues, so many litigants of complicated cases would rightfully prefer a bench trial.  This may be less true for criminal than civil cases, but probably still true to some extent.

Bring back federal physical education mandates in K-12 education.

 

Counterargument

Whether I support it would depend on what your proposal would entail.  I hated that presidential challenge week in school when you had to do a certain number of situps, pull-ups, laps, etc, and they weighed you and measured your body fat.  I support encouraging physical and nutrition education for students, but I don't believe in the "standardized test" aspect, which can be competitive and demoralizing, and I think does not actually encourage overall fitness.

Idea #US54 - End The War on Terror

Fighting ghostlike entities (Terrorists) in the name of national security simply isn't the best use of $500 billion/yr+

 

Counterargument
I'm sure the government has had some success in stopping terrorists and deterring others. Perhaps too much money is spent and perhaps it could be better spent (like education and empowerment campaigns so people aren't drawn to join terrorist organizations), but I don't support stopping these efforts altogether.
